Terms of Service
These Terms of Service ("Terms") govern your access to and use of the nervespan platform and website provided by Nervespan Ltd ("nervespan", "we", "us"). By creating an account or using the service you agree to these Terms.
1. The service
nervespan is a multi-tenant technology strategy platform. We grant you a non-exclusive, non-transferable right to access and use the service in accordance with these Terms and your subscription plan.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.
3. Subscriptions, trials & billing
- Paid plans are billed in advance via our payment provider, Polar, on a monthly or annual cycle as selected at purchase.
- Where a free trial is offered, its length is stated at sign-up. At the end of the trial your plan converts to the paid plan unless you cancel beforehand.
- Fees are as displayed at the time of purchase and are exclusive of any applicable taxes. Except where required by law, payments are non-refundable; if you cancel, your plan remains active until the end of the paid period and is not renewed.
- You may cancel at any time; access continues until the end of the current billing period.
4. Acceptable use
You agree not to misuse the service, including: reverse engineering, attempting to breach security or tenant isolation, uploading unlawful content, or using the service to build a competing product.
5. Your data
You retain ownership of the data you put into nervespan. Our handling of personal data is described in our Privacy Policy and Security & Sub-processors page. You may export your data at any time.
6. Availability
We aim to keep the service available and reliable but do not guarantee uninterrupted access. No formal service-level agreement (SLA) or uptime commitment is provided. We may perform maintenance, and may modify or discontinue features, from time to time.
7. Intellectual property
The service, including its software and design, is owned by Nervespan Ltd and protected by intellectual property laws. These Terms do not transfer any of our IP to you.
8. Warranties & liability
The service is provided "as is" and "as available" to the fullest extent permitted by law, and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, our total aggregate liability arising out of or in connection with these Terms shall not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential losses, or for loss of profits, revenue, or data.
9. Termination
We may suspend or terminate access for breach of these Terms. You may export your data at any time while your account is active, and for 30 days after termination or account closure, after which it is deleted in line with our Privacy Policy.
10. Governing law
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction over any dispute arising out of or in connection with them.
